School boards shall appoint all district superintendents beginning July 1, 2010, replacing the election method for new appointments.

Superintendents currently in office on July 1, 2010, may continue serving until their elected term expires, after which the school board appoints their successor.

County superintendents of education holding office on July 1, 2010, may serve out their elected terms; upon expiration, the school board appoints successors under the same process as district superintendents.

Repeals sections allowing for referendums on elective superintendent positions and repeals provisions for appointment of certain county superintendents, with Section 37-5-61 set to repeal on January 1, 2012.

Requires submission to the U.S. Attorney General or federal court for Voting Rights Act preclearance; effective July 1, 2010, or upon federal approval, whichever is later.
