Amends Section 71-3-121 of the Mississippi Code to make drug and alcohol test results admissible evidence in workers' compensation cases.

Test results, whether employer-administered or conducted otherwise, are admissible solely on the issue of causation in determining if an employee was intoxicated at the time of injury.

Requires insurers to establish safety programs mandating that employers implement written drug and alcohol testing policies compliant with Section 71-7-1 et seq.

Permits employers to require drug and alcohol testing when there is probable cause to suspect an employee's injury was caused primarily by intoxication or illegal drug use that impaired normal faculties.

Takes effect July 1, 2010.
