Permits operation of all-terrain vehicles on government lands (state/local property) under specified safety and compliance requirements, effective July 1, 2010.

Requires all ATV operators to wear a crash helmet meeting National Highway Traffic Safety Administration standards for motorcyclists, comply with manufacturer age and passenger recommendations, and follow all applicable laws and regulations on the property.

Prohibits ATV operation on public roads, streets, and highways unless the governmental authority with jurisdiction explicitly authorizes such use.

Establishes a misdemeanor penalty of up to $100 fine for violations, in addition to any other applicable fines or penalties under law or regulation.

Amends Section 63-7-64 to clarify that motorcycle and motor scooter helmet requirements on public roads remain unchanged and exclude ATVs operating under this act's provisions.
