Amends Mississippi Code Section 99-15-123 to require courts to expunge records when an offender successfully completes a pretrial intervention program, but retain a nonpublic record for use in determining first offender status in subsequent proceedings.

Allows the district attorney to terminate an offender's participation in the pretrial intervention program if the offender violates program conditions, which voids any prior waivers and resumes criminal prosecution.

Maintains existing provisions requiring courts to expunge records in cases where an arrest was made, the person was released, and the case was dismissed, charges were dropped, or no disposition was reached.

Takes effect July 1, 2010.
