Requires all offenders in custody of the Department of Corrections to be tested for HIV upon release, whether housed in state facilities or county jails.

HIV testing shall be conducted by the Department of Corrections and follow existing reporting requirements under Section 41-23-1.

Amends Section 41-23-1 to specify that public correctional facilities housing state offenders must test each offender for HIV upon release from state custody.

Defines "HIV testing" as serological testing of venous blood samples to detect the presence of HIV or its antibodies.

Effective date: July 1, 2010.
