Amends Section 63-11-30 of Mississippi Code to allow imprisonment or confinement for second DUI convictions to include house arrest by a private or public entity or inpatient treatment at an alcohol and drug rehabilitation center.

Applies to persons convicted of a second violation of driving under the influence within five years, requiring fines between $600-$1,500 and imprisonment between 5 days to 1 year.

Maintains existing penalties for first offenses (fines of $250-$1,000, up to 48 hours jail, alcohol safety education) and third or subsequent offenses (felony conviction, $2,000-$5,000 fine, 1-5 years incarceration).

Effective date is July 1, 2010.
