Prohibits possession of an open alcoholic beverage, light wine, or beer container in the passenger compartment of a motor vehicle while operating or occupying the vehicle on any public road, highway, or right-of-way in Mississippi.

Defines "open container" as any glass, metal, plastic or other container with alcoholic beverage or light wine/beer that has been opened, punctured, cut, or constructed to allow consumption without opening.

Establishes exceptions allowing open containers in locked glove compartments, parked house trailers/coaches, hired passenger vehicles (for non-driver passengers), or behind the last upright seat in vehicles without trunks.

Imposes misdemeanor penalty of $100 to $200 fine for violations.

Takes effect July 1, 2010, and preempts any local ordinances imposing more stringent open container restrictions.
