Requires landfills and certain waste disposal sites (Class I or II rubbish landfills, land application sites, processing facilities, and outdoor composting facilities) to be located at least 2,500 feet from any municipality, school, residence, church, or health care facility, effective July 1, 2010.

Allows waste disposal sites to operate closer than 2,500 feet if written agreement is obtained from the governing body, owner, or appropriate representative.

Exempts landfills and waste disposal sites that were in operation before July 1, 2010 from the minimum distance requirement and written agreement requirement, allowing them to continue operating regardless of proximity.

Applies to hazardous waste disposal facilities and requires the Department of Environmental Quality to establish rules and regulations for minimum distance requirements.

Takes effect July 1, 2010.
