Restores "insanity at the time of marriage" as a fault ground for divorce if the complaining party did not know of the infirmity at the time of marriage.

Restores "incurable insanity" as a fault ground for divorce, requiring the insane party to have been confined in a mental illness institution for at least three (3) years immediately preceding the divorce action.

Requires two physicians recognized as authorities on mental diseases to examine the defendant and make affidavits establishing incurable insanity, with one physician being a state psychiatric hospital superintendent or staff member treating the patient.

Mandates appointment of a guardian ad litem to represent the insane person's interests if no legal guardian exists, and allows the court to require a bond for the defendant's lifelong care and maintenance.

Takes effect July 1, 2010.
