Requires health insurance issuers that impose a claim filing deadline on providers to adhere to the same time limit for auditing, reviewing, or seeking reimbursement for invalid or overpaid claims after payment

Where no claim filing deadline is imposed, insurers are prohibited from requesting reimbursement or offsetting payments for invalid or overpaid claims more than 12 months after the original payment

Exempts claims involving misrepresentation, omission, concealment, or fraud by the health care provider from the reciprocal time limitations

Excludes pharmacy audits governed under Section 73-21-175 et seq. and claims submitted under the Mississippi Medicaid Program from the act's requirements

Effective July 1, 2010, applying to health care claims submitted for payment on or after that date; sponsored by Senators Clarke and Dearing during the 2010 Regular Session
