MS SB2135

Amends Mississippi Code sections 13-5-2 and 13-5-26 to allow the master list of potential jurors for circuit court trials to be drawn from the entire circuit court district rather than limited to a single county.

Permits the senior circuit judge of each circuit court district to order a district-wide master list compilation, with the number of names from each county proportional to that county's population relative to the entire district.

Requires prospective jurors summoned from outside their home county to fulfill jury service obligations as if summoned locally, unless they live 35 or more miles from the courthouse and request to be excused.

Limits district-wide jury selection to cases that have experienced at least three of the following: a previous trial, a previous mistrial, or an unsuccessful attempt to impanel an impartial jury.

Takes effect July 1, 2010.
