Senate Bill 2339 Summary

• Adds ephedrine and pseudoephedrine to Schedule III controlled substances under Mississippi Code Section 41-29-117.

• Repeals Section 41-29-315, which previously restricted over-the-counter purchase and sale of ephedrine and pseudoephedrine.

• Maintains ephedrine and pseudoephedrine on the list of precursor chemicals in Section 41-29-313, with possession of more than 24 grams creating a rebuttable presumption of intent to manufacture methamphetamine or other controlled substances.

• Exempts lawful businesses (retailers, wholesalers, pharmacists, manufacturers, and licensed health care professionals) from the rebuttable presumption when possessing these substances in the course of legitimate business.

• Becomes effective July 1, 2010.
