Authorizes local health officers to detain persons diagnosed with active tuberculosis in a hospital or appropriate facility for examination or treatment without a prior court order.

Requires local health officers to apply for a court order within 48 hours (or by the first business day if the deadline falls on a weekend or holiday) after a detained person requests release.

Limits detention without a court order to a maximum of 5 business days after a person requests release.

Requires local health officers to prove the necessity for detention by clear and convincing evidence in any court proceeding to enforce removal or detention orders.

Takes effect July 1, 2010.
