Amends Mississippi Code sections 37-9-103 and 37-9-105 to include assistant teachers in the School Employment Procedures Law protections afforded to licensed educators.

Defines "employee" under the law to include assistant teachers employed continuously for two (2) years with a school district and holding credentials required by the State Department of Education.

Requires school superintendents to provide written notice of nonreemployment to assistant teachers by April 15 or within ten (10) days after the Governor approves the state education budget, whichever is later.

Exempts the notification procedures from applicability during any state of emergency declared by the Governor under the conditions specified in Section 37-17-6(11).

Takes effect July 1, 2010.
