Requires the losing party in a lawsuit based on a written contract, promissory note, or other written agreement to pay reasonable attorney's fees to the prevailing party when the original writing does not include an attorney's fees provision

Applies specifically to cases involving failure to pay amounts due under written agreements

Allows judges to set the amount of reasonable attorney's fees awarded

Awards attorney's fees to defendants who successfully defend against such collection lawsuits

Effective date: July 1, 2010
