Exempts the Mississippi Transportation Commission and Mississippi Department of Transportation from the State Tort Claims Fund effective July 1, 2010.

Requires the Mississippi Transportation Commission to establish and administer its own liability coverage program for commissioners, officers, employees, volunteers, facilities, and activities.

Authorizes the commission to obtain insurance policies, establish self-insurance reserves, or use a combination of both to cover liability claims, with coverage limits and scope no less than those required under the Tort Claims Act.

Requires the commission to budget based on three years of historical claims data and maintain a written statement of financial and liability limits assumed.

Directs the Tort Claims Fund board to calculate reserves for pre-July 1, 2010 claims and refund unused monies to the Department of Transportation as claims are resolved.
