State Department of Health directed to issue a Certificate of Need to Alexander Milne Home for Women, Inc., a 501(c)(3) nonprofit corporation, for not exceeding 45 ICF-MR (Intermediate Care Facility for the Mentally Retarded) beds in Laurel.

The recipient of the certificate must agree to pay the state portion of the Medicaid match for reimbursement rates for these services under a written agreement with the Division of Medicaid.

No prohibition on participation in the Medicaid program for the facility, with Division of Medicaid authorized to make full reimbursement to any nonprofit 501(c)(3) intermediate care facility paying the state's Medicaid match portion.

Certificate of Need requirements for substantial compliance with State Health Plan projections and formal hearing processes are waived for this facility.

Effective upon passage.
