Establishes .08% blood alcohol concentration (BAC) as prima facie evidence of intoxication for boating under the influence violations.

First offense: fine of $250-$1,000 or jail time up to 48 hours, plus mandatory boating safety education course.

Second offense within 5 years: fine of $600-$1,500 and 5 days to 1 year imprisonment or community service, with 1-year watercraft operation ban.

Third or subsequent offense within 5 years: felony charge with $2,000-$5,000 fine and 1-5 years in Department of Corrections custody, with 3-year watercraft operation ban.

Effective July 1, 2010.
