Brings forward Section 7-7-211 of the Mississippi Code of 1972, which codifies the powers and duties of the Department of Audit.

Establishes the State Auditor's authority to audit state agencies, county governments, school districts, junior colleges, and other local entities receiving state funds, with costs shared between the state and audited entities.

Requires school districts to undergo financial audits annually by either the State Auditor or an approved certified public accountant, with the State Auditor conducting audits at least once every four years beginning with fiscal year 2010.

Grants the State Auditor power to demand recovery of misappropriated public funds with one percent monthly interest and authority to pursue civil suits, including imposing up to twelve percent penalties on sureties that fail to respond within 120 days.

Takes effect July 1, 2010.
