HB 105 Summary

• Reenacts and amends Mississippi's Individual On-Site Wastewater Disposal System Law to establish requirements for design, installation, and maintenance of septic systems and wastewater treatment facilities.

• Caps annual certification fees for installers at $50 and allows homeowners to receive free training from manufacturers to maintain their own systems.

• Permits lots of 2 acres or larger to be exempt from department approval if wastewater is contained on the property and certified installers provide signed affidavits confirming compliance.

• Allows homeowners to apply for variances from department approval by submitting reports from certified professional evaluators or registered engineers with proof of errors and omissions insurance.

• Creates a Wastewater Advisory Board composed of 21 representatives from engineering, environmental quality, builders, manufacturers, and water associations to advise the Department of Health on wastewater disposal system regulations.

• Extends the repealer date from July 1, 2011 to July 1, 2013.
