Allows legal actions for relief to be brought against a deceased or mentally incompetent person, provided the action is initiated before the applicable statute of limitations expires.

Prohibits interested persons from testifying as witnesses regarding oral communications between themselves and a deceased or mentally incompetent person in actions against the deceased's estate representatives, heirs, or the incompetent person's guardians.

Creates exceptions to the witness prohibition when the estate representative, heir, or guardian testifies on their own behalf or offers evidence about the oral communication.

Defines "mentally incompetent person" as one incapable of managing property or caring for themselves due to mental illness, disability, drug/alcohol abuse, or other mental incapacity.

Takes effect July 1, 2011.
