House Bill 131 - Mississippi Smoke-Free Air Act of 2011

• Prohibits smoking in all enclosed public places and workplaces statewide, including bars, restaurants, health care facilities, educational institutions, retail stores, and public transportation vehicles.

• Requires at least 80% of hotel and motel rooms to be designated non-smoking, and prohibits smoking in all private and semi-private rooms in nursing homes.

• Establishes outdoor smoking restrictions within 20 feet of entrances and windows of enclosed areas, in outdoor restaurant seating areas, and in public transportation stations and outdoor service lines.

• Imposes penalties including fines up to $50 for individuals smoking in prohibited areas and $100-$500 for business owners/operators who fail to comply, with potential permit or license suspension or revocation.

• Authorizes local health departments, city and county administrators, and private citizens to enforce the act, and allows political subdivisions to adopt more restrictive local ordinances; repeals prior Mississippi smoking restriction laws.
