Pollution control equipment placed in service after July 1, 2011, by manufacturers or custom processors for industrial use is exempt from ad valorem taxation for 10 years from the date of installation, except for school district ad valorem taxes.

"Pollution control equipment" is defined as equipment, devices, machinery, or systems used exclusively and directly to prevent, control, monitor, or reduce air, water, groundwater pollution, or solid or hazardous waste as required by federal or state law or regulation.

The exemption applies only to equipment mandated by federal or state law or regulation.

School district ad valorem taxes on such equipment remain payable during the 10-year exemption period.

The act takes effect July 1, 2011.
