Prohibits deed restrictions or covenants that require property buyers (or their heirs, successors, or assigns) to pay a fee to the original declarant or third party upon future transfers of the property

Declares any such prohibited deed restrictions, covenants, or liens attempting to enforce these fees as void and unenforceable

Exempts fees payable to property owners' associations managing subdivisions with more than one platted lot

Exempts fees payable to 501(c)(3) nonprofit organizations or governmental entities

Effective date: July 1, 2011
