Allows identity theft victims to send certified mail to creditors requesting forgiveness of fraudulently incurred debt and removal from credit reports.

If creditor fails to respond within 60 days of receiving certified letter, victim may petition chancery court in their county or where debt was incurred to compel debt forgiveness.

Victim's petition must include sworn statements proving they did not incur the debt, did not authorize it, had no knowledge of it, did not benefit from it, and filed a formal police report.

Court may issue an order requiring the creditor to release the victim from debt obligations and authorize the victim to request removal of the debt from all credit bureaus.

Takes effect July 1, 2010.
