Creates new crime of indecent assault for knowingly and intentionally touching another person on breast, buttock, inner thigh, groin, genital area, or anal area without consent, whether beneath or outside clothing.

First and second convictions punishable by up to 6 months in county jail and fine not exceeding $500.

Third or subsequent conviction within 5 years (against same or different victims) constitutes a felony punishable by up to 5 years imprisonment in Department of Corrections.

Does not prevent prosecution under existing statutes Section 97-5-23 or 97-3-7.

Effective July 1, 2011.
