MS SB2651

Amends Section 99-19-71 of Mississippi Code to allow expunction of certain nonviolent felonies for first-time offenders who petition the court where convicted.

Excludes from expunction eligibility: traffic violations, crimes of violence, crimes against children, and crimes under Sections 41-29-139 or 41-29-313.

Requires Mississippi Criminal Information Center to retain nonpublic records of expunctions solely to determine first-offender status in future proceedings.

Permits district attorneys to retain nonpublic expunction records for law enforcement purposes and allows employers to ask prospective employees about expunction orders.

Takes effect July 1, 2011.
