HB 1228 Summary

• Low-speed electrical vehicles (20-25 mph) may operate only on roads with posted speed limits of 35 mph or less; medium-speed electrical vehicles (30-35 mph) may operate only on roads with posted speed limits of 45 mph or less, both designated by local governing entities.

• Operation of these vehicles is limited to sunrise to sunset unless equipped with safety equipment meeting 49 CFR Section 571.500 standards, allowing extended hours exemptions by responsible governmental entities.

• Operators must possess a valid driver's license or temporary driver's permit and proof of financial responsibility; vehicles must be registered with county/municipal tax collectors for a $20.00 fee with decal displayed on left rear fender.

• Department of Transportation may prohibit operation of these vehicles on roads under its jurisdiction if determined necessary for safety; counties and municipalities may authorize operation on roads with lower speed limits if consistent with public safety.

• Registration fee of $20.00 is retained by tax collectors and deposited into county or municipal general funds; effective July 1, 2012.
