Exempts consolidations and mergers of hospitals in rural counties from state and federal antitrust laws if they improve access to hospital services and are designated as clearly expressed state policy.

Allows hospitals receiving a certificate of public advantage to consolidate or merge without complying with certain community hospital statutory requirements under Section 41-13-15(7) through (11).

Extends the certificate of public advantage application procedures to hospital consolidations and mergers in rural areas, with approval based solely on whether the agreement provides specified public benefits.

Permits any hospital in a rural county to execute cooperative agreements with other hospitals or health systems upon approval of its board of trustees.

Effective date: July 1, 2012.
