MS HB1351

Amends Section 41-29-146 of the Mississippi Code to prohibit sale, manufacture, or possession with intent to distribute any substance falsely represented to be a controlled substance.

Exempts law enforcement officers acting within their employment and authorized medical practitioners, pharmacists, and other persons legally permitted to dispense controlled substances from the prohibition.

Establishes penalties of up to five years confinement in the Department of Corrections, a fine of up to $5,000, or both for violations.

Takes effect July 1, 2012.
