HB 1404 Summary

• Authorizes law enforcement officers to remove, immobilize, or impound a motor vehicle if the driver is violating motor vehicle safety-responsibility law by not maintaining proof of liability insurance in the vehicle.

• Requires every motor vehicle operated in Mississippi to maintain an insurance card in the vehicle as proof of liability insurance complying with Section 63-15-3(j) liability limits.

• Establishes penalties of $500 fine and one-year suspension of driving privileges for failure to have an insurance card in the vehicle, reduced to $100 if proof of insurance is shown at hearing.

• Allows case dismissal with prejudice and waives court costs if owner shows proof that insurance was in effect at the time of citation.

• Takes effect July 1, 2012.
