Amends the definition of "abuse" of a vulnerable person to clarify it includes acts or omissions that contribute to infliction of physical pain, injury, or mental anguish, and explicitly applies to both mental and physical health.

Adds new definitions including "improper use" (use of resources when a person knows or should know the vulnerable person lacks capacity to consent) and "lacks the capacity to consent" (inability to make responsible decisions about health care, food, clothing, or shelter).

Clarifies that "neglect" applies to failure to maintain a vulnerable person's mental or physical health, and that both abuse and neglect can consist of a single incident.

Expands the definition of "vulnerable person" to include all residents or patients in care facilities regardless of age, and authorizes the Department of Human Services to investigate abuse or neglect at private residences involving care facility patients.

Modifies penalties in Section 43-47-19 to reflect revised language regarding abuse and neglect, including misdemeanor charges for willful acts contributing to neglect or deprivation of services necessary for mental or physical health; effective July 1, 2012.
