Department of Environmental Quality must investigate complaints of environmental contamination of water or soil to determine if contamination exists and whether it is toxic.

Department of Environmental Quality shall notify the local governmental entity of its findings when contamination is identified.

Local governmental entity is required to remove contamination through remedial measures if the contamination is determined not to be the fault of the property owner.

Local governmental entity is authorized to seek redress from any person or entity responsible for the contamination if the party at fault can be determined.

Effective date is July 1, 2012.
