Requires property and casualty insurers to bear the burden of proof by preponderance of the evidence that any policy exclusion applies to a claim or loss in civil actions brought by policyholders under "all perils" coverage policies.

Applies to any civil action alleging the insurer's failure to pay a lawful claim made under the insurance policy.

Applies retroactively to any action filed on or after July 1, 2012, regardless of when the cause of action accrued.

Takes effect July 1, 2012.
