Amends Mississippi Code Section 97-1-5 to create two separate penalties for accessory after the fact based on the underlying felony.

For accessory after the fact involving non-enumerated felonies: imprisonment in Department of Corrections not exceeding 5 years, county jail not exceeding 1 year, or fine up to $1,000, or both.

For accessory after the fact involving capital murder, murder, manslaughter, forcible rape, armed robbery, or kidnapping: imprisonment in Department of Corrections for 5-20 years, or fine up to $50,000, or both.

Prosecutors are not required to prove the principal felon was convicted or tried in order to prosecute accessory after the fact charges.

Effective date: July 1, 2012.
