Clarifies the one-year rescission period for voluntary acknowledgments of paternity under Section 41-57-23, Mississippi Code of 1972.

A signed voluntary acknowledgment of paternity may be rescinded by any signatory within one year or before a judicial proceeding relating to the child (whichever occurs first).

After the one-year rescission period expires, a voluntary acknowledgment may only be challenged in court based on fraud, duress, or material mistake of fact, with the burden of proof on the challenger.

Legal responsibilities and child support obligations arising from the acknowledgment cannot be suspended during a challenge, except for good cause shown.

Takes effect upon passage.
