Exempts cottage food operations from regulation by state and local health departments as "food establishments" or "food service establishments"

Defines "cottage food operation" as an individual operating from their home producing baked goods, canned jams or jellies, or dried herbs with annual gross income of $50,000 or less, selling only directly to consumers

Requires cottage food operations to label all foods sold with the operation's name and address and a statement that food is not inspected by the State Department of Health

Prohibits cottage food operations from selling food through the Internet and prohibits local health departments from regulating production at cottage food operations, though they must maintain records of complaints

Effective July 1, 2012
