Requires a transitional school year following three consecutive years of Low-Performing, At-Risk of Failing, or Failing status before a school converts to a conversion charter school under Section 37-165-5 and 37-165-7.

Requires a transitional school year following three consecutive years of Failing status before a school is transformed into a new start school under the Mississippi Recovery School District under Section 37-167-1.

Maintains existing requirements for conversion charter schools including parent petition approval, local management board governance, academic performance contracts, and State Board of Education oversight.

Applies to schools first classified beginning in the 2009-2010 school year, with the transitional year serving as the fourth year before actual conversion or new start school transformation occurs.

Takes effect July 1, 2012.
