Contractors awarded bids for public works projects funded by federal disaster relief, spill penalties, or similar sources must submit an employment plan detailing job types, skill levels, wages, number of vacant positions, and recruitment strategies for low-wage and unemployed individuals.

Contractors must enter into an agreement requiring them not to hire personnel for ten (10) days after bid acceptance, during which the Mississippi Department of Employment Security submits qualified candidates for the contractor to review before hiring non-submitted applicants.

Contractors must register with the Mississippi Department of Employment Security for taxation purposes and provide proof of registration with their bid.

The Mississippi Department of Employment Security shall develop an annual report tracking contractor hiring data to improve workforce training programs and tailor trainings to employer needs for in-demand jobs.

The act applies to public works projects utilizing funds from federally declared disasters, spills of national significance, court orders, negotiated settlements, and federal legislation including R.E.S.T.O.R.E., the Oil Pollution Act of 1990, and the Federal Water Pollution Control Act.
