Allows counties to elect to pay employer contributions to the Public Employees' Retirement System on the net fee income of constables, in addition to direct county payments.

Modifies Section 25-11-106 to authorize counties to assume responsibility for employer contributions on constable fee income, with constables remaining responsible for employee contributions on those fees.

Requires counties that elect this option to appropriate sufficient funds in their budgets to cover employer contributions on both net fee income and direct payments to constables.

Establishes procedures for counties to remit these contributions through the clerk of the board to the Public Employees' Retirement System alongside other county officer contributions.

Effective date: October 1, 2012.
