Requires the Department of Health to reimburse landowners for diminished property value if the department fails to approve an individual on-site wastewater disposal system for land adjacent to a lake, but only for property purchased prior to July 1, 2008.

Establishes that the department must approve or disapprove wastewater system requests within five working days and must provide written reasons for disapprovals.

Allows homeowners to apply for variances from department requirements by submitting certified professional reports and proof of errors and omissions insurance, which the department must grant while retaining inspection authority.

Deems wastewater system requests automatically approved if the department does not respond within ten calendar days of the request.

Takes effect July 1, 2012.
