Calculate public assistance benefit eligibility by considering the combined incomes of all persons residing in the same household as the applicant, whether related or not.

Administering agencies (Department of Human Services and Division of Medicaid) must obtain income and residence information from the Department of Revenue tax returns and other state agencies to verify household composition and income.

Income and residence information reported to state agencies on tax returns, applications, or other forms is presumed accurate; applicants disputing this information bear the burden of proof to demonstrate correct figures.

Administering agencies must apply for federal waivers from the U.S. Secretary of Health and Human Services to implement these provisions for TANF, economic assistance programs, and Medicaid.

Effective date is July 1, 2012.
