Senate Bill 2713 Summary

• Prohibits smoking in all enclosed public places and places of employment throughout Mississippi, including bars, restaurants, health care facilities, educational facilities, gaming facilities, and transportation venues.

• Bans smoking in private clubs and enclosed residential facilities such as nursing homes and hotel/motel guest rooms, with exemptions only for private residences not used as childcare, adult day care, or health care facilities.

• Restricts smoking in outdoor areas within 20 feet of building entrances, windows, and ventilation systems; outdoor restaurant and bar seating areas; playgrounds; public transportation stations; and sports arenas and bleachers.

• Establishes enforcement through local health departments, city managers, and county administrators with penalties including fines of $50 for individuals smoking in prohibited areas and $100-$500 for business owners failing to comply, plus potential suspension or revocation of business licenses.

• Repeals the existing Mississippi Clean Indoor Air Act (Sections 29-5-160, 29-5-161, and 29-5-163) and authorizes the Mississippi Department of Health to promulgate rules and regulations for implementation, effective July 1, 2012.
