Senate Bill 2836 Summary

• Requires persons convicted of any drug-related offense under Section 41-29-139 to complete at least 30 days of drug rehabilitation instruction as a condition of bail, sentence, probation, or suspension of sentence.

• Requires persons convicted of drug offenses who are dependent on or addicted to controlled substances to receive at least 30 days of medical treatment for such dependency or addiction.

• Allows credit toward rehabilitation requirements for time spent in instruction or treatment after arrest and before conviction.

• Requires parolees or probationers whose drug test shows unauthorized presence of a controlled substance to complete either at least 30 days of drug education instruction or at least 30 days of medical treatment if dependent on or addicted to controlled substances.

• Effective July 1, 2012.
