Brings forward Section 41-19-33 of Mississippi Code to establish and clarify the powers and duties of regional mental health/intellectual disability commissions appointed by county boards of supervisors.

Authorizes regional commissions to establish, operate, and maintain mental health facilities and services including treatment for mental illness, intellectual disabilities, alcoholism, drug abuse, and services for aging populations.

Requires regional commissions to submit annual operational plans to the Department of Mental Health by July 1 each year, with deficient providers given a six-month probationary period to meet minimum standards before potential decertification and loss of state funding.

Grants commissions authority to contract with public and private entities, borrow money from private lenders, acquire property, employ personnel, obtain insurance, and participate in managed care programs (multi-region arrangements require Department of Mental Health approval).

Establishes that surplus funds exceeding one-half of annual operating budget must be submitted as a capital improvement plan within 45 days, or state appropriated funds will be withheld until a plan is submitted or funds are expended on approved mental health services.
