MS HB1070

Amends the Capital Expense Fund to include repair and renovation of institutions of higher learning and community/junior colleges, expanding eligible projects to include site infrastructure, code compliance, weatherization, roofing, demolition, HVAC systems, and furniture/equipment replacement, with a $3,000,000 per-project limit.

Requires the Legislature to appropriate funds to maintain minimum unencumbered balance levels in the Capital Expense Fund, escalating from 0.2% of state building replacement value in fiscal year 2013 to 1.0% in fiscal year 2022 and thereafter.

Allows the Bureau of Building, Grounds and Real Property Management to distribute Capital Expense Fund monies to higher education institutions, community colleges, the Department of Corrections, and the Department of Wildlife, Fisheries and Parks starting in fiscal year 2017, with percentages increasing from 0.2% to 0.5% of each entity's building replacement value.

Requires institutions and agencies receiving distributed funds to comply with annual reporting requirements and prohibits use of funds for administrative costs, employee salaries, or travel; any unexpended funds must be returned to the Capital Expense Fund unless reappropriated by the Legislature.

Mandates the Department of Finance and Administration submit annual reports to the Legislature detailing all repair and renovation projects funded by the Capital Expense Fund, including project names, scopes, budgets, professionals, expenditures, and funding sources.
