Reserves regulation of consumer incentive items and nutrition labeling of food and nonalcoholic beverages in restaurants, retail food establishments, and vending machines exclusively to the Mississippi Legislature through statewide legislation enacted after July 1, 2013.

Prohibits political subdivisions from enacting local legislation or conditioning licenses and permits based on provision of food nutrition information or consumer incentive items at food service operations.

Prohibits political subdivisions from banning or restricting foods based on nutrition information, food-based health disparities, or the presence or absence of consumer incentive items.

Prohibits political subdivisions from restricting the sale, distribution, growing, or serving of foods and nonalcoholic beverages approved by the U.S. Department of Agriculture or other federal or state government agencies.

Does not affect federal regulation of nutrition labeling under the Federal Food, Drug, and Cosmetic Act; becomes effective July 1, 2013.
