HB 1368 - Sexual Offenses Against Children Act

• Creates the "Sexual Offenses Against Children Act" defining sexual offenses against minors to include sexual conduct, solicitation, use in sexual performances, kidnapping, false imprisonment, child pornography, and related attempts or conspiracies.

• Establishes mandatory minimum sentences ranging from 10 years to life imprisonment depending on circumstances (death results in life imprisonment or death penalty; serious bodily injury requires 30+ years; bodily injury requires 20+ years; dangerous weapon requires 15+ years; other cases require 10+ years).

• Requires convicted offenders to register as sex offenders, undergo electronic monitoring wearing location-transmitting devices for probation/supervised release terms (minimum 5 years to life), and pay restitution to victims.

• Establishes victim rights including protection from the accused, notice of court proceedings and releases, right to attend court, right to be heard at release/plea/sentencing hearings, and right to restitution.

• Makes it a felony punishable by up to 2 years imprisonment or $100,000 fine to assist sexual offenders in evading law enforcement or provide false information to police; amends statute of limitations to allow prosecution of sexual offenses against minors without time restriction.
