Reserves regulation of nutrition labeling for food, nonalcoholic beverages, and menu items in restaurants, retail food establishments, and vending machines exclusively to the state Legislature and Commissioner of Agriculture and Commerce

Prohibits local governments and political subdivisions from enacting any legislation regarding food nutrition information or consumer incentive items (toys, games, prizes) at food service operations

Bars local governments from banning, restricting, or conditioning licenses for food establishments based on nutrition information, food-based health disparities, or the inclusion of consumer incentive items like toys with meals

Grants the Commissioner of Agriculture and Commerce authority to adopt statewide rules on food nutrition information and consumer incentive items, including establishing civil penalties for violations

Preserves federal nutrition labeling requirements under the Federal Food, Drug, and Cosmetic Act, effective July 1, 2013
