Prohibits sellers or lessors from imposing a surcharge on buyers or lessees who choose to pay with a credit card instead of cash, check, or similar means.

Allows sellers to offer discounts for payment by cash, check, or non-credit card methods if the discount is clearly and conspicuously offered to all prospective customers.

Exempts state agencies, counties, municipalities, community hospitals, and other governmental entities from the prohibition when assessing credit card processing fees to users.

Establishes criminal penalties of up to 60 days in county jail and/or a fine of up to $500 for violations.

Takes effect July 1, 2013.
